Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the Venture West Aviation website at flyvwa.com (the "Site"), enrollment in our flight training programs, and all related services (collectively, the "Services"). By accessing our Site or enrolling in any of our programs, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree to these Terms, you must not use our Site or Services. These Terms constitute a legally binding agreement between you and Venture West Aviation, LLC ("Venture West Aviation," "we," "us," or "our"), located at 4517 E. Mallory Cir, Ste 129, Mesa, AZ 85215.

1. Eligibility

To use our Services and enroll in our flight training programs, you must:

  • Be at least 16 years of age (or 17 for certain certificates as required by FAA regulations)
  • Meet all FAA medical requirements applicable to the certificate(s) you are pursuing
  • Comply with all TSA citizenship verification requirements (AFSP for non-U.S. citizens)
  • Provide accurate and complete information during enrollment
  • Have the legal capacity to enter into a binding agreement

2. Flight Training Programs

2.1 Program Enrollment

Enrollment in any Venture West Aviation flight training program is subject to availability and acceptance by our admissions team. Submitting an application or inquiry does not guarantee enrollment. We reserve the right to decline enrollment at our discretion.

2.2 Training Standards

All flight training is conducted under Federal Aviation Regulations (FARs) Part 61. Venture West Aviation is not a Part 141 flight school. Training hours and requirements are in accordance with FAA minimums and our standardized training curriculum. Actual training hours required may vary based on individual student performance and proficiency.

2.3 Certificates and Ratings

References to "certificates" on our Site and materials refer to FAA pilot certificates (e.g., Private Pilot Certificate, Commercial Pilot Certificate, Airline Transport Pilot Certificate). The term "Instrument Rating" is the correct FAA terminology for the instrument flight qualification. Venture West Aviation facilitates training toward these certificates and ratings but does not issue them; all certificates and ratings are issued solely by the FAA.

2.4 Training Schedule and Progress

Estimated program timelines are approximate and are not guaranteed. Training progress depends on various factors including weather conditions, aircraft availability, student scheduling, individual proficiency, and FAA examiner availability. We make every reasonable effort to maintain training continuity but cannot guarantee uninterrupted training.

2.5 Aircraft and Equipment

Training aircraft are subject to availability and may be substituted at our discretion. Aircraft maintenance, inspections, and airworthiness requirements take priority over training schedules. We reserve the right to ground any aircraft at any time for safety or maintenance reasons.

3. Aviator Assurance Program

The Aviator Assurance benefit is available exclusively to students enrolled in the Airline Pilot Academy, Credit for PPL, or Pinnacle Pathway programs. Aviator Assurance provides one (1) free checkride retake per certificate stage if a student does not pass on the first attempt.

The following conditions apply to Aviator Assurance:

  • Aviator Assurance covers checkride (practical test) retakes only; stage check retakes are not covered
  • Only one (1) free checkride retake is provided per certificate or rating
  • If a student exceeds the allotted training hours included in their program, the student is responsible for the cost of any additional training hours required
  • Aviator Assurance does not cover additional ground instruction, additional flight hours beyond the retake, or any other fees
  • Aviator Assurance is non-transferable and has no cash value
  • Venture West Aviation reserves the right to modify or discontinue the Aviator Assurance program at any time

4. Unlimited Ground School

The Unlimited Ground School benefit is available exclusively to students enrolled in the Airline Pilot Academy, Credit for PPL, or Pinnacle Pathway programs. This benefit provides unlimited access to ground school instruction for the duration of the student's active enrollment in the applicable program.

  • Unlimited Ground School access terminates upon program completion, withdrawal, or dismissal
  • Access is limited to scheduled ground school sessions and does not include private tutoring or one-on-one instruction unless otherwise specified
  • Venture West Aviation reserves the right to modify the format, schedule, or availability of ground school sessions

5. Tuition, Fees, and Payment

5.1 Program Costs

All program costs, tuition, and fees are outlined during the admissions process and in your enrollment agreement. Prices are subject to change without prior notice for future enrollments. Your enrollment agreement will specify the costs applicable to your program at the time of enrollment.

5.2 Payment Terms

Payment is due in accordance with the terms outlined in your enrollment agreement. We offer various payment options including financing through third-party lenders and custom payment plans. Specific payment terms, schedules, and amounts are established during the admissions process.

5.3 Third-Party Financing

Financing through third-party lenders or lending platforms (including but not limited to ELMSelect financing and Stratus Financial) is subject to the terms and conditions of those providers. Venture West Aviation does not guarantee approval for financing and is not responsible for the terms, interest rates, or conditions imposed by third-party providers. Co-signers may be required by lending institutions.

5.4 Included Items (Certain Programs)

The following items are included in tuition for students enrolled in qualifying Academy programs (Airline Pilot Academy, Credit for PPL, and Pinnacle Pathway). Availability may vary for individual certificate students — contact admissions for details.

  • FAA written (knowledge) exam fees
  • Headset for use during training
  • iPad with ForeFlight subscription for use during training

5.5 Additional Costs

Students are responsible for certain additional costs not included in program tuition, which may include but are not limited to:

  • FAA medical examination fees
  • Additional training hours beyond program allotments
  • TSA background check fees (for non-U.S. citizens)
  • Personal study materials and equipment not provided by the program
  • Transportation and lodging

5.6 Late Payments

Failure to make payments on time may result in suspension of training, late fees, and/or dismissal from the program. Venture West Aviation reserves the right to withhold training records and endorsements until all outstanding balances are paid in full.

6. Withdrawal & Financial Adjustment

6.1 Tuition Structure & Market Rate Adjustment

Venture West Aviation offers competitive training rates calculated using a discounted tuition structure extended exclusively to students enrolled and actively progressing in the Airline Pilot Academy program. Should a student request to withdraw from the program, the student understands and agrees that all previously used training hours will be retroactively recalculated at current market rates as follows:

Market Rate Schedule Upon Withdrawal:

  • Aircraft Flight Instruction (Single Engine): $275 per hour
  • Aircraft Flight Instruction (Multi Engine): $525 per hour
  • Ground Instruction: $80 per hour
  • Simulator Instruction: $175 per hour

Any difference between the discounted program rate and the standard market rate becomes immediately due upon withdrawal. This adjustment reflects the true cost of training outside of the Academy's bundled tuition model.

6.2 Financial Obligations & Non-Refundable Amounts

All non-refundable portions of tuition paid at enrollment remain non-refundable under all circumstances. Any remaining and recalculated balances must be satisfied in full in accordance with the terms of the original enrollment agreement. Failure to meet these obligations may result in the initiation of legal action to recover outstanding amounts, including but not limited to collection of attorney's fees, court costs, and any associated expenses incurred by Venture West Aviation.

6.3 Withdrawal Processing & Student Responsibility

Upon execution of a withdrawal agreement, Venture West Aviation will process the student's withdrawal and provide a final itemized balance reflecting the recalculated training costs at market rates. The student agrees to satisfy all remaining financial obligations promptly. Any delay or failure to do so constitutes a material breach, entitling Venture West Aviation to pursue all available legal remedies including injunctive relief and recovery of damages.

6.4 Release of Claims

In consideration of the tuition structure, recalculated training costs, and withdrawal processing, the withdrawing student fully and irrevocably releases Venture West Aviation, its officers, employees, agents, and affiliates from any and all claims, demands, liabilities, or causes of action arising from or related to their participation in or withdrawal from the program. This release is comprehensive and unconditional.

6.5 Non-Disparagement

As part of any withdrawal agreement, the student agrees to refrain from any negative, disparaging, or harmful statements regarding Venture West Aviation or any of its programs. Any breach of this provision will entitle Venture West Aviation to seek damages, legal fees, and injunctive relief.

7. Student Responsibilities

As a student of Venture West Aviation, you agree to:

  • Maintain a valid FAA medical certificate appropriate to the certificate(s) you are pursuing
  • Arrive prepared and on time for all scheduled training sessions
  • Cancel or reschedule training sessions with a minimum of 24 hours' notice; late cancellations or no-shows may incur fees
  • Follow all safety procedures, rules, and regulations at all times
  • Comply with all applicable FAA, TSA, and local regulations
  • Maintain appropriate conduct and treat all staff, instructors, and fellow students with respect
  • Not operate any aircraft while under the influence of drugs, alcohol, or any impairing substance
  • Report any safety concerns, incidents, or accidents immediately
  • Maintain your own renter's insurance as recommended

8. Unconditional Waiver of Liability & Assumption of Risk

By enrolling in any Venture West Aviation program, the student acknowledges the risks inherent to pilot training, including the possibility of personal property damage, serious bodily injury, or death. The student voluntarily, unconditionally, fully, and completely releases and forever discharges, holding harmless, Venture West Aviation, its owners, officers, directors, agents, employees, independent contractors, assigns, and affiliates (the "Venture West Releasees"), from any and all claims of liability of any kind whatsoever, including but not limited to demands, obligations, losses, fees, fines, penalties, and liabilities (including attorney's fees and costs), regardless of whether it is the direct result of the Venture West Releasees' negligence or breach of contract, resulting directly or indirectly from enrollment and/or participation in Venture West's Airline Pilot Academy.

8.1 Inherent Dangers

The student understands that in order to qualify for Federal Aviation Administration ("FAA") certification, he/she must demonstrate proficiency in flight maneuvers designated to simulate emergency situations, and such maneuvers are dangerous and unlikely in the course of normal flight. The student further understands and acknowledges that Venture West Aviation does not guarantee or warrant the student's proficiency and that completion of the training program (or portions thereof) or certification does not guarantee proficiency. The student willingly assumes all risks associated with flight training.

8.2 Freedom of Choice

The student acknowledges that:

  • The student is or seeks to become a certificated pilot and acknowledges that pilot training is inherently dangerous
  • Entering into this agreement and receiving flight training constitutes transactions that involve interstate commerce
  • The student has other options for flight training and has freely and voluntarily entered into this agreement as a matter of choice

8.3 Waiver of Jury Trial

THE PARTIES HEREBY VOLUNTARILY, KNOWINGLY, IRREVOCABLY, AND UNCONDITIONALLY WAIVE ANY RIGHT TO HAVE A JURY PARTICIPATE IN RESOLVING ANY DISPUTE (WHETHER BASED UPON CONTRACT, TORT, OR OTHERWISE) BETWEEN OR AMONG THE PARTIES ARISING OUT OF OR IN ANY WAY RELATED TO THESE TERMS OR ANY RELATIONSHIP BETWEEN THE PARTIES. THIS PROVISION IS A MATERIAL INDUCEMENT TO EACH PARTY TO ENTER INTO THIS AGREEMENT.

8.4 Attorney's Fees

Any party who commences or defends an action against the other to enforce any of the terms of this agreement or because of a breach by either party of any of its terms and is successful in such prosecution or defense shall recover from the losing or defaulting party reasonable attorney's fees, costs, and expenses incurred in connection with the prosecution or defense of such action.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VENTURE WEST AVIATION, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, INSTRUCTORS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO VENTURE WEST AVIATION DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

NOTHING IN THESE TERMS SHALL LIMIT LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED BY LAW.

10. Indemnification

You agree to indemnify, defend, and hold harmless Venture West Aviation, its owners, officers, directors, employees, instructors, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of our Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your negligent or wrongful conduct during training activities.

11. Intellectual Property

All content on our Site, including text, graphics, logos, images, videos, course materials, training syllabi, and software, is the property of Venture West Aviation or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Reproduce, distribute, modify, or create derivative works from any content on our Site without our prior written consent
  • Use our trademarks, logos, or branding without our prior written authorization
  • Copy, share, or distribute any proprietary training materials, ground school content, or course curricula

12. Dismissal and Termination

Venture West Aviation reserves the right to suspend or dismiss any student from a program at any time for any of the following reasons:

  • Failure to meet payment obligations
  • Unsafe conduct or repeated failure to follow safety procedures
  • Violation of FAA regulations or Venture West Aviation policies
  • Failure to maintain a valid FAA medical certificate
  • Disruptive, disrespectful, or threatening behavior
  • Operating or attempting to operate aircraft while impaired
  • Failure to make satisfactory training progress after reasonable remediation
  • Any other conduct that, in our sole judgment, poses a risk to safety or is detrimental to our operations

Dismissal does not relieve you of any outstanding financial obligations. Refund eligibility upon dismissal is governed by your enrollment agreement.

13. Website Use

13.1 Accuracy of Information

While we strive to keep our Site content accurate and up-to-date, we make no warranties or representations regarding the accuracy, completeness, or currency of any information on our Site. Program details, pricing, schedules, and other information are subject to change without notice.

13.2 Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Site or its systems
  • Interfere with or disrupt the Site or its servers
  • Transmit any harmful code, viruses, or malware
  • Scrape, harvest, or collect data from the Site without our consent
  • Impersonate any person or entity

14. Disclaimers

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

VENTURE WEST AVIATION DOES NOT GUARANTEE THAT YOU WILL OBTAIN ANY SPECIFIC FAA CERTIFICATE OR RATING, SECURE EMPLOYMENT AS A PILOT, OR ACHIEVE ANY PARTICULAR OUTCOME FROM OUR TRAINING PROGRAMS. SUCCESS IN FLIGHT TRAINING DEPENDS ON NUMEROUS FACTORS INCLUDING INDIVIDUAL ABILITY, EFFORT, AND EXTERNAL CONDITIONS BEYOND OUR CONTROL.

SALARY FIGURES, EMPLOYMENT STATISTICS, AND CAREER PROJECTIONS REFERENCED ON OUR SITE ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND ARE NOT GUARANTEES OF FUTURE EARNINGS OR EMPLOYMENT.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or your use of our Services shall be resolved as follows:

  • Informal Resolution: The parties shall first attempt to resolve any dispute informally through good-faith negotiation for a period of thirty (30) days
  • Mediation: If informal resolution fails, the parties agree to submit to non-binding mediation in Maricopa County, Arizona
  • Litigation: If mediation is unsuccessful, any legal action shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of such courts

16. Force Majeure

Venture West Aviation shall not be liable for any failure or delay in performing its obligations under these Terms to the extent such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions or restrictions, FAA regulatory changes, weather events, labor disputes, supply chain disruptions, or acts of terrorism.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

18. Entire Agreement

These Terms, together with your enrollment agreement and any other agreements executed between you and Venture West Aviation, constitute the entire agreement between the parties regarding the subject matter herein and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

19. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our Site or Services after any changes constitutes your acceptance of the revised Terms. Material changes may be communicated via email to enrolled students.
